Rustic Pines is a residential development marketed by Hudson Modern Co. This website exists to help you understand the homes, the lots, the finishes, and the process. It is a marketing guide and nothing more.

Nothing on this site is an offer to sell, a solicitation of an offer to buy, or a binding commitment of any kind. No statement here creates a contract, a warranty, or an obligation on the part of Hudson Modern Co, the builder, or anyone acting for them.

The contract is final

The purchase contract, together with the plans, specifications, and warranty documents attached to or referenced in it, is the complete and exclusive agreement between you and the seller. It supersedes this website, every brochure, every email, every rendering, and every conversation that came before it.

Where anything on this site differs from the contract, the contract governs. Nothing on this site may be used to add to, vary, contradict, or explain the contract, and no representation made here may be relied on as a basis for a claim against Hudson Modern Co or its agents.

Read the contract in full. Satisfy yourself that everything you are counting on — the price, the plan, the specification, the lot, the schedule, the warranty — is written into it. If it matters to you and it is not in the contract, it is not part of your purchase.

Retain your own attorney

You should be represented by your own New York attorney before you sign anything. Real estate licensees are not permitted to give legal advice or to draft or modify contract terms for you, and nothing on this site is legal, tax, financial, engineering, or construction advice.

Have your attorney review the purchase contract, the title, the survey, the homeowners association documents, the warranty, and any lender documents. Do not sign until you are comfortable with all of it.

What our salespeople can and cannot tell you

Hudson Modern Co is a licensed real estate broker in the State of New York. Its salespeople are licensed to market and sell real property. They are not attorneys, architects, engineers, surveyors, lenders, appraisers, tax advisers, or licensed contractors, and nothing they tell you should be taken as advice in any of those fields.

A new home is built and warranted under a different body of law than the one governing the brokerage of an existing house. Construction quality and the builder’s warranty obligations are governed by New York’s Housing Merchant Implied Warranty, General Business Law article 36-B (§§ 777 through 777-b), and by the terms of your contract with the builder — not by anything said in the course of marketing the home. Questions about how the house will be built, what it will cost to build, how long it will take, or what the warranty covers should be directed to the builder in writing and confirmed in your contract.

Estimates of price, taxes, insurance, timing, square footage, acreage, or monthly payment shown anywhere on this site are illustrative only. They are not quotations, appraisals, commitments, or predictions, and actual figures will differ.

Renderings, photography, and plans

Images on this site include photographs of completed Rustic Pines homes, architectural renderings of homes not yet built, and photographs in which furnishings or landscaping have been added digitally. Renderings and staged images are illustrations of a design intent, not depictions of a specific home as it will be delivered.

Floor plans, dimensions, square footage, lot lines, acreage, site plans, finishes, fixtures, appliances, and features are subject to change without notice and must be confirmed for the specific home you are considering. Lot lines and site plans shown are approximate and are not a survey.

Prices and availability change. A home shown as available may be under contract or sold by the time you enquire.

No guarantees

This site is provided as is and as available. To the fullest extent permitted by law, Hudson Modern Co disclaims all warranties of any kind relating to this site and its content, express or implied, including any implied warranty of accuracy, completeness, merchantability, or fitness for a particular purpose.

Information here is drawn from sources believed reliable but is not guaranteed and is subject to errors, omissions, changes in price, prior sale, or withdrawal without notice.

Nothing in this section limits the housing merchant implied warranty that New York law provides on the sale of a new home, or any other right you cannot waive by agreement. Those rights are set out in your contract and in the statute, and this website neither grants nor removes them.

Indemnification

By using this site you agree to indemnify, defend, and hold harmless Hudson Modern Co, its members, officers, employees, licensees, and agents from and against any claim, demand, loss, liability, or expense, including reasonable attorneys’ fees, arising out of your use of this site or your reliance on information published on it.

This does not apply to any claim arising from Hudson Modern Co’s own fraud, wilful misconduct, or gross negligence, or to any liability that cannot be disclaimed or shifted under New York law.

Governing law

These terms are governed by the laws of the State of New York without regard to its conflict of laws rules. Any dispute arising out of them shall be brought in the state or federal courts sitting in Ulster County, New York.

If any provision of these terms is held unenforceable, the rest remain in effect. We may update these terms at any time; the version posted here governs your use of the site.
